Payment Terms
Payment Schedule
- • Monthly website plans require a 12-month agreement
- • The first monthly payment is due when the agreement is signed and before work begins
- • All 12 monthly payments are required once the agreement is accepted
- • Remaining monthly payments are billed automatically each month during the agreement term
- • Upfront custom builds may require a separate deposit and payment schedule
- • Additional work billed at agreed-upon rates
- • Late payments subject to 1.5% monthly interest
No Refunds
All payments are non-refundable. Monthly website plan payments, custom build deposits, setup payments, and completed work payments are not refundable once paid.
Project Terms and Conditions
Project Timeline
Project timelines are estimates and may vary based on complexity, client feedback, and scope changes. We'll communicate any delays promptly.
Revisions
We include 3 rounds of revisions in our standard packages. Additional revisions may incur additional charges.
Project Completion
Projects are considered complete when all agreed-upon deliverables are provided and approved by the client.
Limitation of Liability
To the maximum extent permitted by law, Jabz Web Design shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Loss of profits or business opportunities
- Data loss or corruption
- Service interruptions
- Third-party actions or content
Our total liability shall not exceed the amount paid by you for the specific service giving rise to the claim.
Disclaimers
Service Availability
Our services are provided "as is" and "as available" without warranties of any kind. We do not guarantee uninterrupted service or error-free operation.
Third-Party Services
We may use third-party services and tools. We are not responsible for their performance, reliability, or security.
Termination
Either party may terminate this agreement with written notice:
- For convenience with 30 days written notice
- Immediately for material breach of these terms
- Upon completion of the agreed-upon services
Upon termination, you remain responsible for payment of completed work and any outstanding balances.
Governing Law and Disputes
These Terms shall be governed by and construed in accordance with the laws of the State of New York, United States.
Any disputes arising from these Terms or our services shall be resolved through good faith negotiation. If resolution cannot be reached, disputes shall be resolved through binding arbitration in Buffalo, New York.
Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of our services constitutes acceptance of the modified Terms.
